El artículo analiza la tesis intencionalista como solución a problemas de indeterminación en la interpretación jurídica. La investigación se limita a la indeterminación producida por dos rasgos del lenguaje, a saber, la vaguedad y la textura abierta. Según la tesis intencionalista el intérprete debe, en estos casos, recurrir a la intención del autor del texto. Para evitar ciertas objeciones a esta tesis, pero también para mostrar sus límites, se analiza su funcionamiento en la interpretación de los contratos y se muestra (...) que la intención no permite solucionar problemas de vaguedad, aunque sí parece servir para, en ciertos casos, resolver problemas de textura abierta. Sin embargo, en la última sección, se exponen las dificultades que surgen cuando se intenta identificar la intención del autor del texto y que precluyen la posibilidad de que permita resolver concluyentemente los problemas de indeterminación. Miguel de Unamuno celebra la locura del Quijote como una afirmación del “yo” en su Vida de don Quijote y Sancho. Para G.K. Chesterton la afirmación radical del “yo” es el elemento fundamental de la locura, pero no algo para ser celebrado. Para Chesterton la locura del Quijote no está tanto en la afirmación de su propio “yo” sino en la afirmación de una realidad olvidada, invisible para quienes se han acostumbrado a vivir en un mundo que ha perdido el (...) juicio: es el único cuerdo en un mundo de locos. Elementos de esta lectura del Quijote pueden encontrarse, a pesar de Unamuno, en la Vida de don Quijote y Sancho; es Unamuno, más que el Quijote, quien afirma su “yo” a costa de la realidad. In these brief comments on Bruno Celano’s “Pre-conventions. A Fragment of the Background”, I propose further thoughts on what, following Celano’s analysis, I call embodied conventions. I begin with a number of remarks on Celano’s philosophical method. Then I claim, first, that the social dimension of conventionality remains obscure in his account of embodied conventions, and, second, that his account of pre-conventions is still imprecise due to the ambiguity of the notion of the Background.

A hemi-implicative lattice is an algebra \((A,\wedge,\vee,\rightarrow,1)\) of type (2, 2, 2, 0) such that \((A,\wedge,\vee,1)\) is a lattice with top and for every \(a,b\in A\), \(a\rightarrow a = 1\) and \(a\wedge (a\rightarrow b) \le b\). A new variety of hemi-implicative lattices, here named sub-Hilbert lattices, containing both the variety generated by the \(\{\wedge,\vee,\rightarrow,1\}\) -reducts of subresiduated lattices and that of Hilbert lattices as proper subvarieties is defined. It is shown that any sub-Hilbert lattice is determined (up to isomorphism) by (...) a triple (_L_, _D_, _S_) which satisfies the following conditions: _L_ is a bounded distributive lattice, _D_ is a sublattice of _L_ containing 0, 1 such that for each \(a, b \in L\) there is an element \(c \in D\) with the property that for all \(d \in D\), \(a \wedge d \le b\) if and only if \(d \le c\) (we write \(a \rightarrow _D b\) for the element _c_), and _S_ is a non void subset of _L_ such that _S_ is closed under \(\rightarrow _D\) and _S_, with its inherited order, is itself a lattice. Over recent years, various semantics have been proposed for dealing with updates in the setting of logic programs. The availability of different semantics naturally raises the question of which are most adequate to model updates. A systematic approach to face this question is to identify general principles against which such semantics could be evaluated. In this paper we motivate and introduce a new such principle the refined extension principle. Such principle is complied with by the stable model semantics for (single) (...) logic programs. It turns out that none of the existing semantics for logic program updates, even though generalisations of the stable model semantics, comply with this principle. For this reason, we define a refinement of the dynamic stable model semantics for Dynamic Logic Programs that complies with the principle. (shrink)

Comment on Joseph Raz, From Normativity to Responsibility.

Quantum indistinguishability directly relates to the philosophical debate on the notions of identity and individuality. They are crucial for our understanding of multipartite quantum systems. Furthermore, the correct interpretation of this feature of quantum theory has implications that transcend fundamental science and philosophy, given that quantum indistinguishability is a resource in quantum information theory. Most of the conceptual analysis of quantum indistinguishability is restricted to studying the permutational invariance of quantum states, the concomitant quantum statistics and their entanglement. Here, we (...) analyse the role of indistinguishability and non-individuality in other areas of quantum theory. We start by analysing how a very peculiar use of indistinguishability underlies Feynman’s rules for summing amplitudes in interference phenomena. Next, we study how quantum indistinguishability is underestimated in several topics of debate in the quantum physics literature, such as the Einstein–Podolsky–Rosen argument, Bell’s inequalities and the Bell–Kochen–Specker theorem. Finally, we argue that an ontology of truly indistinguishable entities can serve as a basis for a quantum ontology that can give interesting answers to the interpretational problems of quantum mechanics. We claim that, in addition to superposition, contextuality and entanglement, indistinguishability (understood in a robust ontological sense) is one of the central features of quantum physics. -/- . The Kochen-Specker theorem is one of the fundamental no-go theorems in quantum theory. It has far-reaching consequences for all attempts trying to give an interpretation of the quantum formalism. In this work, we examine the hypotheses that, at the ontological level, lead to the Kochen-Specker contradiction. We emphasize the role of the assumptions about identity and distinguishability of quantum objects in the argument.

El objetivo del presente trabajo es presentar los primeros pasos de una reconstrucción estructuralista de la teoría alostérica MWC. Esta teoría fue presentada en dos artículos publicados en Journal of Molecular Biology, en el primero de ellos “Allosteric proteins and cellular control systems”, de 1963, una versión simplificada, y en el segundo, “On the nature of allosteric transitions: a plausible model”, publicado en la misma revista en 1965, una versión más acabada. The goal of this article is to show that formal analysis and reconstructions may be useful to discuss and shed light on substantive meta-theoretical issues. We proceed here by exemplification, analysing and reconstructing as a case study a paradigmatic biochemical theory, the Monod-Wyman-Changeux theory of allosterism, and applying the reconstruction to the discussion of some issues raised by prominent representatives of the new mechanist philosophy. We conclude that our study shows that at least in this case mechanicism and more traditional (...) accounts are not rivals but complementary approaches. (shrink)

The aim of this study was to implement the teaching personal and social responsibility model in a competitive context analyzing the differences between the intervention and the control group on personal and social responsibility, prosocial behaviors, and self-efficacy in youth soccer players. Participants were 34 youth soccer players between the ages of 14 and 16 years old divided into two different soccer teams of 17 members, corresponding to the control and intervention groups. The implementation of the TPSR model took place (...) during 9 months, including initial and ongoing coach training, program implementation, and a series of expert-led seminars for athletes. The questionnaires used to collect data were the Personal and Social Responsibility Questionnaire, Prosocial Behavior Scale, and two Children’s Self-efficacy Scales. Results indicated that the TPSR intervention group obtained an increase in post-test levels of personal and social responsibility, prosocial behavior, and self-efficacy due to the application of the TPSR model compared with control group that used a conventional sport teaching methodology. The conclusion is that the TPSR model has the potential to be adapted and implemented with flexibility in youth sport competition contexts in order to improve personal and social responsibility, prosocial behavior, and self-efficacy. Esta nova caraterização tem sido acusada de gerar uma “ansiedade pluralista”. Escopo deste artigo é reconstruir os problemas que, segundo Corti, surgem a partir da virada argumentativa do filósofo, assim como avaliar se McDowell tem à disposição recursos conceituais para esquivar-se às críticas. Para isso, contamos com a seguinte estrutura de (...) texto: 1. reconstruiremos em detalhe a posição revisada de McDowell acerca da experiência perceptual tal como ela foi exposta em AMG; 2. reconstruiremos o argumento de Corti acerca da possibilidade de que a nova posição de McDowell implique no surgimento de uma “ansiedade pluralista”; 3. discutiremos se é possível fornecer uma interpretação da posição de McDowell que ofereça uma saída para tal ansiedade. In this work, we discuss a formal way of dealing with the properties of contextual systems. Our approach is to assume that properties describing the same physical quantity, but belonging to different measurement contexts, are indistinguishable in a strong sense. To construct the formal theoretical structure, we develop a description using quasi-set theory, which is a set-theoretical framework built to describe collections of elements that violate Leibnitz's principle of identity of indiscernibles. This framework allows us to consider a new ontology (...) in order to study the properties of quantum systems. (shrink)

El control biológico de especies no nativas que causan daños económicos y ambientales es la tecnología más importante de la Biología de las Invasiones. Si bien hay acuerdo que dicha tecnología es ambientalmente más amigable que el control químico, existen discusiones abiertas sobre los riesgos asociados a la misma. En el presente trabajo analizamos, utilizando como fuentes artículos científicos de revisión, las bases epistémicas subyacentes al desarrollo y la evaluación de riesgos asociados al control biológico. En particular, si sucede o (...) no simplificación epistemológica y su vínculo con la subestimación de riesgos. El análisis muestra que suceden cuatro tipos interrelacionados de simplificación epistemológica: i) interacciones uno-a-uno de tipo fisiológicas, linealizadas y descontextualizadas entre agente de control y especies blanco o no-blanco; ii) predominancia de factores de niveles organísmico e infra-organísmico, en vinculación con teorías y conceptos de la Ecofisiología; lo que obvia interacciones, procesos y mecanismos que suceden a nivel de comunidad y ecosistemas, y los marcos teóricos de la Ecología asociados; iii) exclusión de mecanismos evolutivos relevantes como la adaptación y la plasticidad fenotípica post-introducción; y iv) restricción de temporalidades y espacialidades a aquellas de procesos fisiológicos y comportamentales del nivel organísmico o inferiores. Este escenario deriva en una subestimación, o directamente omisión, de riesgos ambientales como alteraciones potenciales que el evento de control biológico puede imponer sobre especies no-blanco y también sobre procesos y mecanismos comunitarios y ecosistémicos. Proponemos una teoría estética basada en un enhebrado cronotópico del discurso creativo que replantea las lógicas de constitución del sujeto. Tomamos como hilo conductor la película La voz de la luna (La voce della Luna, 1990) de Federico Fellini, cuyo surrealismo, lejos de suponer una construcción al azar de un relato, revela una sofisticada narrativa desde lo circunstancial (y no desde el sujeto o el objeto). Es aquí donde confluimos con las tesis más radicales de Antonin Artaud y su (...) proyecto político basado en el teatro de la crueldad y la reificación del fragmento-órgano. Concluimos con un alegato por una narración vital, que trascienda la obra, disipe la posición del sujeto en la misma (lo que Jacques Derrida denomina Forcener le subjectile) para que el sentido de la humanidad, en lo ínfimo y fragmentado, trasparezca. Mi propósito en este trabajo es reconsiderar una de las lecturas más relevantes y provocativas que se han hecho sobre John Dewey en el mundo de habla hispana. En la primera parte reconstruyo las circunstancias que rodearon la difusión, interpretación y traducción de las obras de Dewey en el México de mediados de los años 1940, y en concreto las razones que llevaron a que la visión sociológica que José Medina Echavarría quiso dar de Dewey fuera finalmente desplazada por (...) la filosófica de José Gaos. En la segunda parte analizo la traducción y lectura que Gaos hizo de Experience and Nature de Dewey, teniendo muy presente sus comparaciones con Sein und Zeit de Heidegger . Finalmente, propongo algunas críticas a la visión que Gaos transmite de Dewey como un pensador carente de un tipo de "soberbia diabólica" propia de la verdadera gran filosofía. The purpose of this work is a reconsideration of one of the most relevant and provocative readings of John Dewey written in the Hispanic World. In the first part I reconstruct the circumstances which surrounded the publicity, interpretation and translation of John Dewey's works in the Mexico of the middle 1940's, particularly the reasons why the sociological reading of Dewey that José Medina Echavarría proposed was finally displaced by the metaphysic perspective of José Gaos. In the second part I reconsider Gaos' own translation and interpretation of Experience and Nature, taking in consideration his comparisons with Heidegger's Sein und Zeit . Finally I analyze critically Gaos' view of Dewey as a thinker whose philosophy lacked the "diabolical arrogance" that true great philosophy would seem to require. (shrink)

Se trataba de los libros Adolfo Sánchez Vázquez: los trabajos y los días y En torno a la obra de (...) Adolfo Sánchez Vázquez, editados por Federico Álvarez y Gabriel Vargas Lozano, respectivamente. Publicado originalmente con el título “La empecinada herejía de Adolfo Sánchez Vázquez” en la mencionada revista (núm. 203, La Habana,1996, pp.142-147), el texto fue revisado y actualizado para la presente edición. We explore the distinctive characteristics of Mexico's society, politics and history that impacted the establishment of genetics in Mexico, as a new disciplinary field that began in the early 20th century and was consolidated and institutionalized in the second half. We identify about three stages in the institutionalization of genetics in Mexico. The first stage can be characterized by Edmundo Taboada, who was the leader of a research program initiated during the Cárdenas government (1934-1940), which was primarily directed towards improving (...) the condition of small Mexican farmers. Taboada is the first Mexican post-graduate investigator in phytotechnology and phytopathology, trained at Cornell University and the University of Minnesota, in 1932 and 1933, respectively. He was the first investigator to teach plant genetics at the National School of Agriculture and wrote the first textbook of general genetics, Genetics Notes, in 1938. Taboada's most important single genetics contribution was the production of "stabilized" corn varieties. The extensive exile of Spanish intellectuals to Mexico, after the end of Spain's Civil War (1936-1939), had a major influence in Mexican science and characterizes the second stage. The three main personalities contributing to Mexican genetics are Federico Bonet de Marco and Bibiano Fernández Osorio Tafall, at the National School of Biological Sciences, and José Luis de la Loma y Oteyza, at the Chapingo Agriculture School. The main contribution of the Spanish exiles to the introduction of genetics in Mexico concerned teaching. They introduced in several universities genetics as a distinctive discipline within the biology curriculum and wrote genetics text books and manuals. The third stage is identified with Alfonso León de Garay, who founded the Genetics and Radiobiology Program in 1960 within the National Commission of Nuclear Energy, which had been founded in 1956. The Genetics and Radiobiology Program rapidly became a disciplinary program, for it embraced research, teaching, and training of academics and technicians. The Mexican Genetics Society, created by de Garay in 1966, and the development of strains and cultures for genetics research were important activities. One of de Garay's key requirements was the compulsory training of the Program's scientists for at least one or two years in the best universities of the United States and Europe. De Garay's role in the development of Mexican genetics was fundamental. His broad vision encompassed the practice of genetics in all its manifestations. (shrink)

The paper deals with the interpretation of Wittgenstein's views on the power of occurrent mental states to sort objects or states of affairs as in accord or in conflict with them, as presented in the rule-following passages of the Philosophical Investigations. I shall argue first that the readings advanced by Saul Kripke and John McDowell fail to provide a satisfactory construal of Wittgenstein's treatment of a platonist account of this phenomenon, according to which the sorting power of occurrent mental states (...) is to be explained by reference to the mind's ability to grasp universals. I contend that the argument that Kripke extracts from Wittgenstein's discussion doesn't succeed in undermining the platonist position. Then I argue that McDowell's reading exhibits a more serious shortcoming: the position that he ascribes to Wittgenstein is indistinguishable from the platonist account. Then I put forward a proposal as to how to articulate the relationship between Wittgenstein's views and the platonist position. (shrink)

While some form of loss of control is often assumed to be a common feature of the diverse manifestations of addiction, it is far from clear how loss of control should be understood. In this paper, I put forward a concept of decrease in control in addiction that aims to fill this gap and thus provide a general framework for thinking about addictive behavior. The development of this account involves two main steps. First, I present a view of degrees of (...) control as the degree to which an agent would be responsive to potential or counterfactual sufficient reasons to do otherwise. Second, I sketch an account of the relevant control-undermining factors in addiction that is consonant with my proposed view of degrees of control. Being a high-level functional property, reasons-responsiveness is particularly well suited to frame an account of control-undermining factors that is doubly pluralistic: it encompasses the contribution of factors both internal and external to the agent, and it is consistent with various proposals as to the precise nature of the anomaly taking place in the psychology of addiction. A restrictive view of self-control identifies exercises of self-control with synchronic intrapsychic processes, and pictures diachronic and externally-scaffolded strategies not as proper instances of self-control, but as clever ways of avoiding the need to exercise that ability. In turn, defenders of an inclusive view of self-control typically argue that we should construe self-control as more than effortful inhibition, and that, on grounds of functional equivalence, all these diverse strategies might be properly described as instances of self-control. In this paper, I (...) take a fresh look at this debate by focusing on cases of addiction. I argue that addicted agents face a paradigmatic sort of self-control challenge, which makes addiction an important test case for theories of self-control. And I discuss evidence that highlights both the unreliability of synchronic intrapsychic strategies and the crucial role that is played by diachronic and externally-scaffolded strategies in successful attempts at achieving abstinence by addicted individuals. Abstaining addicts are a paradigmatic case of agents who successfully exercise self-control, and they mostly do so by relying on diachronic and externally-scaffolded strategies. This, I argue, lends further support to an inclusive view of self-control. (shrink)

Frente a quienes denuncian sus supuestas aporías y exagerado negativismo, se reivindica aquí la actualidad de una de sus tesis más conocidas y discutidas, la de la aniquilación del individuo. El paso del capitalismo liberal al monopolista sirve de horizonte para analizar las contradicciones del individuo burgués y su constitución social. En una segunda (...) parte se aborda la «debilidad del yo» como aquella configuración psíquica que se corresponde con la liquidación del individuo en la sociedad tardocapitalista. En el centenario del nacimiento de Th. W. Adorno valgan estas reflexiones de homenaje a un pensador y un pensamiento cada día más imprescindibles. (shrink)

This paper argues that the crucial feature of the drug-related desires experienced by addicted agents is not that they ‘push’ the agent with a force she cannot oppose, but that they are not easily undermined by things that normally have the ability to undermine desires —in other words, that they are extraordinarily recalcitrant. As a result, the disposition to experience these desires is very persistent over the long-term, manifesting itself in particular episodes of wanting to use drugs that recur with (...) great frequency. Both the persistence and the recurrence of these desires, it is argued, contribute to a diminished ability to respond to relevant reasons that speak against drug use. (shrink)

The timing of the Japanese Government's acceptance of the United Nations multilateral treaties governing several environmental concerns indicates Japan's priorities: biodiversity, global warming, and depletion of the ozone layer. Banning transboundary movement of hazardous wastes is the least prioritized, as indicated by Japan's failure to accept the Ban Amendment to the Basel Convention. The Japanese Environment Agency's policy statements and budget allocations between 1985 and 2000, as well as other official statements and programs, likewise indicate the same priorities. After describing Wittgenstein's notion of ‘certainty’, in this article I provide four arguments to demonstrate that no certainty can be acquired at will. Specifically, I argue that, in order to assimilate a certainty, it is irrelevant whether the individual concerned has found a ground that seemingly justifies that certainty; has a given mental state; is willing to accept the certainty on the proposal of a persuader; or tries to act according to the certainty involved. O objetivo do artigo é apresentar como Simondon concebe o objeto técnico, a mediação e o ensino refletido da técnica. Num primeiro momento será apresentada a defesa dos objetos técnicos frente a acusação de restrição da experiência humana, da cultura. Num segundo, será apresentada a genealogia do objeto técnico, compreendido enquanto mediação entre o homem e a natureza, para então abordar o tema do ensino refletido da técnica.

Estudo introdutório de apresentação, seguido de tradução, da palestra “Fenomenologia e antropologia”, ministradas por Edmund Husserl nas sedes da Kantgesellschaft de Frankfurt, Berlim e Halle em 1931, na qual avalia criticamente, a partir dos pressupostos transcendentais da fenomenologia, a tendência da filosofia alemã dos anos 20 do século passado para uma antropologia filosófica.

El ensayo busca fundamentar la vigencia del concepto martiano de Nuestra América y del proyecto de sociedad y de pensamiento que este entraña. Se realiza un análisis comparativo de la idea compartida por Hegel y Martí sobre la centralidad que pueden asumir ciertos pueblos en la Historia y el diferente papel que cada uno le asigna a América en el concierto universal de naciones. Se analiza la posibilidad de que sea por fin el XXI el siglo de Nuestra América, los (...) elementos que confirman el inicio de su realización y los retos y peligros que la consumación de esa posibilidad enfrenta.
